We may update these Terms from time to time, and your continued use of our site or services after any changes indicates your acceptance of the new Terms.

Acceptance of Terms

By using the Smith Street Dental website or booking our dental services, you acknowledge that you have read, understood, and agree to these Terms & Conditions. This agreement applies to all visitors, users, and patients of Smith Street Dental. If you are using our online booking system or any interactive features, you also agree to any guidelines or rules posted in those sections. We reserve the right to refuse service or access to the website to anyone who breaches these Terms. These Terms form a legally binding agreement between you (the “Patient” or “User”) and Smith Street Dental, a dental clinic based in Darwin, Northern Territory, Australia. If you are obtaining dental services from us, you may be asked to agree to additional terms (such as treatment consent forms or financial agreements); those will complement these Terms.

If you do not agree with any part of these Terms, you should refrain from using our website or services. We may modify these Terms at any time by updating this page. It is your responsibility to check this page periodically for changes. Your continued use of the website or our services after changes are posted constitutes acceptance of the amended Terms.

Services Offered

Smith Street Dental provides a range of dental services, including cosmetic dentistry (e.g. veneers, teeth whitening, Invisalign) and general dentistry (e.g. check-ups, fillings, crowns, implants) in our Darwin clinic. All information about our services on this website is provided for general information purposes in plain English.

While we strive to ensure that service descriptions, treatment information, and pricing details are accurate and up to date, the website content is not intended as professional dental or medical advice specific to your personal health condition. Any reliance you place on information on this site is at your own risk. For advice tailored to your situation, please schedule a consultation with our qualified dental professionals.

No Guarantee of Results: We aim to help every patient achieve a healthy and beautiful smile, but individual results can vary. Any testimonials or before-and-after images on our site are illustrative of particular cases and do not constitute a guarantee that you will achieve the same results. We will provide our services with due care and skill; however, outcomes of dental treatments depend on many individual factors. We encourage you to discuss expected outcomes, risks, and benefits of any procedure with our dentists before proceeding.

Our dentists are registered with the Australian Health Practitioner Regulation Agency (AHPRA) and the Dental Board of Australia, and we adhere to all relevant dental practice regulations and guidelines in the Northern Territory. This ensures that our services meet professional standards of care and safety.

Booking and Payment Terms

Smith Street Dental offers the convenience of online appointment booking through our website. When you book an appointment online, you are submitting a request for dental services on a preferred date and time. Booking requests are subject to confirmation by our clinic.

We will typically confirm your appointment via email, SMS, or phone call. If your requested slot is unavailable or needs to be changed, we will contact you to arrange an alternative time. By making a booking (whether online, by phone, or in person), you agree to provide true, accurate, current, and complete information. This includes your contact details, and any relevant medical or dental history when asked, so that we can best prepare for your appointment. You are responsible for keeping your contact information up to date with us so we can reach you for appointment reminders or changes.

Payment Terms: Our clinic provides various payment options for services, which may include cash, EFTPOS, credit/debit cards, and certain approved payment plans or financing options. For some treatments or long appointments, we may require a deposit or pre-payment to secure your booking. If a deposit is required, you will be informed of the amount and payment due date at the time of booking. Deposits paid will be applied toward the cost of the treatment or consultation. All prices for our services (if listed on the website or quoted) are in Australian Dollars (AUD) and include GST where applicable, unless stated otherwise.

Payment for dental services is generally due at the time of service (for example, at the end of your appointment) unless you have arranged a payment plan or other financing in advance. If you use our online payment facilities (such as paying a deposit or invoice through the website), you agree to comply with any terms of the third-party payment processor.

We use reputable secure payment gateways to protect your financial information; however, you should ensure that you are using a secure network when entering payment details. Smith Street Dental is not responsible for any bank fees, currency charges, or third-party fees that may apply to your transactions. Payment Plans and Financing: We may offer information about third-party financing or payment plan options to help you manage the cost of treatments (for example, installment plans or credit services through specialized medical finance providers). Please note that Smith Street Dental does not provide financial or credit advice. Any decision to enter a payment plan or credit arrangement is solely your choice.

We strongly recommend you consider your financial situation carefully and consult with a trusted financial advisor if needed before entering into any third-party financing agreement. All financing plans are subject to approval by the third-party provider, as well as their terms and conditions. Smith Street Dental is not the creditor in such cases; we simply facilitate the introduction to the provider and the convenience for our patients.

Cancellations and Refunds

We understand that sometimes you may need to change or cancel your dental appointment. Our cancellation policy is designed to be fair and considerate of both your needs and those of our other patients and staff:

  • Rescheduling or Cancelling Appointments: If you need to cancel or reschedule your appointment, please provide us with as much notice as possible. We request at least 24 hours’ notice for cancelling or changing a standard appointment, and at least 48 hours’ notice for longer appointments or surgical procedures. This allows us to offer the slot to other patients who may be waiting for care.
  • Late Cancellations and No-Shows: Cancellations made on short notice (less than the requested 24 or 48 hours, as applicable) or failure to attend a scheduled appointment (no-show) may incur a fee. For appointments that required a deposit, a late cancellation or no-show will typically result in the forfeiture of the deposit. For other appointments, we reserve the right to charge a missed appointment fee to cover the professional time that was set aside for you. We will always consider exceptional circumstances (such as emergencies) – please communicate with us if such a situation arises.
  • Clinic Cancellations: In the rare event that Smith Street Dental needs to cancel or reschedule your appointment (for example, due to dentist illness, equipment failure, or other unforeseen circumstance), we will provide you with as much advance notice as possible. We will work with you to arrange a new appointment time that suits you, or offer a refund of any pre-paid amount or deposit if rescheduling is not possible or convenient for you.

Refunds for Services: Our goal is to ensure you are satisfied with the dental care you receive. If you have pre-paid for a treatment or paid a deposit and you cancel within the allowed notice period, you are generally entitled to a refund or credit of that amount. Any refunds of payments made (for example, for advance payments on treatment packages) will be processed using the original payment method when possible. Please allow a reasonable time for the refund to be processed (it may take several business days for banks or credit card companies to return funds).

For services that have already been provided, we do not typically offer refunds simply for change of mind. If you have concerns about the quality or outcome of a treatment you received, we encourage you to contact us so we can address the issue through remedial treatment or other appropriate solutions, in accordance with Australian Consumer Law and professional dental standards. Smith Street Dental will honor our obligations under the Australian Consumer Law – for instance, if a service we provided fails to meet a consumer guarantee (e.g., was not carried out with due care and skill, or was not fit for the purpose you made known to us), then you may be entitled to a remedy such as a fix, replacement service, or refund, as appropriate. Nothing in these Terms removes or restricts your rights to such remedies under law.

Provision of Dental Services: Smith Street Dental will provide dental services with due care, skill, and in accordance with professional standards.

However, to the extent permitted by law, our liability for any claims arising out of the provision of our dental services or treatments is limited. In no event will Smith Street Dental, our dentists, or staff be liable for any indirect, incidental, special, or consequential damages arising from treatment or services provided, except where liability cannot be excluded by law. We do not exclude liability for personal injury or property damage caused by our negligence, or for any other liability which cannot be lawfully excluded or limited. Australian Consumer Law: Nothing in these Terms is intended to exclude or restrict any guarantees, warranties, or rights you may have under the Australian Consumer Law (ACL) or other applicable laws. Under the ACL, you may be entitled to certain remedies (such as refunds, repairs, or repeat services) if our services fail to meet a consumer guarantee. Any limitations of liability set out in these Terms are subject to and will not apply to the extent that they contravene your rights under the ACL or other laws. In other words, we do not seek to exclude any legal rights or remedies that cannot be excluded by law. By using our website or services, you agree that any liability on the part of Smith Street Dental (if established by a court or competent authority) will be limited, at our discretion, to either: (a) supplying the services again, or (b) the payment of the cost of having the services supplied again. This limitation is in line with the options permitted under the Australian Consumer Law for services that do not meet a guarantee. Again, this limitation applies only to the extent permitted by law.
